The El Paso County Board of Commissioners is considering an ordinance that would require the removal of unsafe buildings from unincorporated areas of the county.
Any building or structure would be deemed unsafe under the ordinance if it:
- presents a substantial danger or hazard to public health or safety
- is materially dilapidated and unused by the owner
- is frequented by trespassers or transients; or
- subjects adjoining property owners to danger of damage by storm, soil erosion or rodent infestation
Building owners would first be sent a notice that a violation has occurred and must be corrected within 30 days. If not corrected, a hearing will take place before the Board of County Commissioners to decide the appropriate course of action.
The board may authorize the initiation of criminal prosecution and also has the right to remove any unsafe building or structure that has not been properly addressed.
A second reading of the ordinance is scheduled for March 17.
